ENDOWMENT MORTGAGE COMPLAINT

The Financial Services Authority requires all insurance companies to keep their customers up to date and informed using ‘re-projection letters’. Insurance companies must write to their client at least once every two years regarding the status of their individual fund. This letter will include details of the anticipated or predicted value of the fund. A ‘red letter’ will indicate that the fund is not on target and is at risk of shortfall. An amber letter means that the fund is on target but that there may be potential problems in the future. A green letter shows that the fund is on track.

If you receive a red letter it is vital that you seek professional independent advice as soon as possible. A red letter means that you can make an endowment mortgage complaint to claim compensation provided that there is evidence of mis selling. The FSA rules impose a time limit of three years for making a claim after receipt of the first red latter. Most insurance companies will not settle a claim if it falls outside of the time limits.

On June 1st 2004 a new regulation was introduced that required insurance companies to inform their policy holders exactly how long they have to make an endowment mortgage complaint before the potential claim becomes time barred. There must usually be at least six months between the warning and the deadline date.
