Sales by solicitors for policies bought after the 30th of November 2001 are in the same category as sales by other financial advisers and The Financial Ombudsman Service has authority to determine claims if the solicitor refuses compensation or if the amount of compensation cannot be agreed following an admission of miss selling by the solicitors firm :-
For sales made before the 30th of November 2001 by solicitors or by financial advisors employed by solicitors then the rules are very different as liability to determine a contested matter falls upon the Law Society for the relevant jurisdiction. There are different Law Societies for England and Wales, Scotland and Northern Ireland as technically each country is a different legal jurisdiction. If the sale was before the 30th of November 2001 then a formal complaint letter should be sent to the firm of solicitors and if they either refuse the claim or the amount of compensation cannot be agreed then an approach should be made to the relevant law society which have limited powers to order compensation even when endowment policy complaints are valid. In all cases the limitation period applies and application should be made for endowment shortfall compensation within three years of receipt of a red warning letter. If you have received an amber letter you should keep a close eye on the situation and ensure that you make enquiries after two years if you have not received a subsequent letter which may be red and require urgent action.
