  • If property is offered for sale at an undervalue as a result of advice tendered by an estate agent there is a real and immediate loss caused to the seller if the sale is eventually agreed at the undervalue.
  • If property is offered for sale at a price that is to high the seller may incur excessive advertising costs and the delay in a sale may incur bank charges and bridging loans resulting in a direct loss with the further possibly of the loss of an intended purchase.
  • Changing market conditions may mean that a property that was initially offered at the correct price has become overvalued or undervalued with the passage of time resulting in the financial consequences outlined above.
  • A vendor may be held to be responsible for losses as a result of negligent miss-statement by an estate agent if that miss-statement ultimately induced the buyer to enter into a contract.
