Making a claim for policy misselling can be a difficult experience and most policyholders do not even attempt to make a claim. The complications of proving they have been a victim of misselling and the risk of not getting a settlement appear to be sufficient enough to deter many people from taking legal action. Homeowners also seem to be disinclined to embark on a legal struggle over a complicated financial subject that they have little or no understanding about. Applying for compensation can be an arduous experience and many of those in primary need of help are being failed by the very system built to uphold their rights. We are on hand for anyone who wants to find out whether the law considers them the victim of misselling and we will give free initial advice with absolutely no further obligation.
The Financial Service Authority guidelines only allow victims of misselling to make a claim within three years of receiving a ‘Red’ letter warning them of a projected shortfall. If they do not act within this time limit, victims are precluded from making a complaint and will never receive any compensation for their losses. It is important to move swiftly when you have received a ‘Red’ letter and have decided to make a claim. Compensation settlements that may be awarded do not depend on how well your policy is currently performing, but rather on the long-term balance of the investment.
The initial stage of an endowment claim is to make a form application to the insurance company however those people who have their complaint rejected by the provider tend not to take their problem further, as they are entitled to do, by seeking an order from the Financial Ombudsman Service, which saves the insurance companies millions of pounds every year. These insurance companies are content with the likelihood of misselling complaints being rejected or expiring before they have been properly dealt with and as such are failing to look after the interest of their customers. Recent Government proposals to stop financial firms from rejecting so many legitimate claims is an unprecedented move leading towards thousands of pounds worth of further compensation being awarded to those policyholders who have suffered financially as a result of endowment misselling.
